These Terms of Use, hereinafter the "Terms", are intended to govern the conditions of access to and use of the KazaKlub website and platform.

They define the rights, obligations, and liabilities applicable to users, members, Klub creators, Kaza owners or holders, and any person accessing the service.

Use of the site and platform implies unreserved acceptance of these Terms. Users acknowledge having read them before any registration, browsing, or use of the features offered.

These Terms must be read together with the Legal Notice, the Privacy Charter, the Cookie Policy, and, where applicable, the Terms of Sale or Subscription Terms applicable to paid offers.

1. Definitions

For the purposes of these Terms, the following terms shall have the meaning below:

• KazaKlub refers to the company KazaKlub SAS, publisher of the site and platform.
• Site refers to the website accessible at kazaklub.com, as well as any associated page, interface, feature, or space.
• Platform refers to all the digital services offered by KazaKlub, notably enabling account creation, Klub management, presentation of Kazas, invitation of members, consultation of availability, exchange of information, and organization of stays or lending arrangements in a private setting.
• User refers to any person accessing the site or using the platform, whether a simple visitor, registered member, Klub creator, guest, owner, holder, or user of a Kaza.
• Member refers to any user with an account on the platform.
• Klub refers to a private circle, closed group, or restricted community created or joined by members to organize the sharing, lending, or access to Kazas in a chosen setting.
• Kaza refers to a home, house, apartment, second home, family home, space, or any other real estate presented on the platform by a user.
• Klub creator refers to the member who creates, administers, or runs a Klub.
• Kaza holder refers to the member who presents, lends, organizes, or shares a Kaza on the platform. This term may refer to an owner, an authorized occupant, or any person declaring that they have the necessary rights over the property concerned.
• Content refers to any text, image, photograph, description, message, rule, document, information, data, profile element, listing, or content published, transmitted, or provided by a user.
• Services refers to the features offered by KazaKlub, free or paid, present or future.

2. Purpose of the platform

KazaKlub is a digital platform designed to structure the sharing, lending, organization, and access to homes or real estate within private circles and trusted communities.

The platform notably allows users to:

• create an account;
• complete their profile;
• create, join, or administer a Klub;
• invite members into a private circle;
• present one or more Kazas;
• view Kazas accessible within their Klubs;
• organize availability;
• exchange with other members;
• share useful rules, information, or documents;
• facilitate the coordination of a stay or a lending arrangement in a private setting.

KazaKlub provides a digital infrastructure for organization, community matchmaking, and access management between members. The platform does not replace each user's own vigilance, discernment, checks, and responsibilities.

3. Acceptance of the Terms

Access to the site and use of the platform are subject to full and unreserved acceptance of these Terms.

Acceptance may notably result from:

• creating an account;
• validating a registration form;
• checking an acceptance box;
• actual use of the services;
• creating or viewing a Klub or a Kaza.

By accepting these Terms, users declare that they have the legal capacity necessary to be bound by them.

If users do not accept these Terms, they must immediately stop using the site and platform.

KazaKlub reserves the right to deny access to any user who does not comply with these Terms or whose use is likely to harm the platform, other members, or KazaKlub's legitimate interests.

4. Access conditions and eligibility

Use of the platform is reserved for adult natural persons with full legal capacity.

When registering, users certify that they:

• are at least 18 years old;
• have the necessary legal capacity;
• provide accurate, complete, and up-to-date information;
• use the platform for personal, fair, lawful use consistent with its purpose;
• do not create an account on behalf of a third party without authorization;
• do not impersonate another person.

KazaKlub reserves the right to request certain proof or additional information in case of doubt regarding a user's identity, age, status, rights, or behavior.

Access to certain services may be limited, suspended, or conditional on specific criteria, in particular in the case of a paid offer, a restricted feature, a private beta, verification, or invitation.

5. Creation and management of the user account

To benefit from certain features, users must create a personal account.

Users agree to provide accurate, truthful, complete, and up-to-date information.

Users are solely responsible for:

• the accuracy of the information provided;
• the confidentiality of their credentials;
• use of their account;
• actions carried out from their account;
• invitations, publications, messages, or decisions made via their account.

Users agree not to disclose their credentials to a third party and to inform KazaKlub immediately in the event of loss, theft, unauthorized access, suspected hacking, or fraudulent use of their account.

KazaKlub cannot be held liable for the consequences of unauthorized access resulting from negligence, sharing of credentials, an insufficiently secure password, or careless behavior by the user.

KazaKlub may suspend or delete an account in the event of fraudulent, abusive, unlawful use, use contrary to these Terms, or use likely to harm the security of the platform.

6. How Klubs work

Klubs are private circles that allow members to group together around a family, friendship, professional, association, affinity, or community bond.

The creator or administrator of a Klub is responsible for running it, its internal rules, the invitations sent, and the management of members.

KazaKlub may provide tools notably enabling users to: create a Klub; invite members; accept or decline requests; manage the visibility of Kazas; exchange with members; define certain organizational rules; centralize useful information.

Each Klub member agrees to comply with the rules defined by the Klub's creator or administrators, provided that they are lawful and consistent with these Terms.

KazaKlub does not guarantee the quality of relationships between members of the same Klub, the permanence of bonds of trust, the absence of disagreement, the availability of Kazas, or members' compliance with the Klub's internal rules.

A user may be removed from a Klub, have their access limited, or lose certain features under the conditions provided by the platform, by the Klub's rules, or by these Terms.

7. Creating, presenting, and managing Kazas

Users who present a Kaza on the platform declare that they have the rights, authorizations, and capacity necessary to do so.

They notably guarantee, depending on their situation:

• that they own the property or have sufficient authorization;
• that they comply with the rules applicable to their home;
• that they comply with co-ownership, lease, occupancy, insurance, neighborhood, urban planning, tax, and local regulations;
• that they do not publish misleading or manifestly inaccurate information;
• that they have the necessary rights over the photographs, texts, and content published;
• that they do not offer a dangerous, unlawful, unsanitary property, or one contrary to public order.

Users are solely responsible for information relating to their Kaza, notably: description; location; photographs; amenities; access rules; availability; specific conditions; any restrictions; practical information; compliance of the property; safety and use of the home.

KazaKlub does not guarantee the availability, compliance, safety, habitability, quality, condition, location, accuracy of information, or suitability of a Kaza to meet a user's expectations.

KazaKlub reserves the right to remove, hide, or suspend a Kaza whose content is manifestly unlawful, fraudulent, misleading, abusive, contrary to these Terms, or likely to harm security, third-party rights, KazaKlub's image, or the proper operation of the platform.

8. Organization of stays and lending arrangements

KazaKlub facilitates the organization of stays, access, or lending arrangements between members, but is not a party to the agreements entered into between users.

The concrete terms of a stay or lending arrangement are the exclusive responsibility of the users concerned.

It is notably up to users to define among themselves: dates; access arrangements; usage rules; arrival and departure conditions; authorized persons; any restrictions; respective responsibilities; practical arrangements related to the home; any specific rule applicable.

KazaKlub does not systematically control the exchanges, agreements, or conditions defined between users. The platform does not act as an agent, guarantor, lessor, landlord, real estate agency, hotel operator, travel agency, insurer, or party responsible for the stay.

Each user remains responsible for their decisions, their behavior, the information communicated, the use of the Kaza, respect for the property, the Klub's rules, and the legal or contractual obligations applicable to them.

9. No rental transaction imposed by KazaKlub

KazaKlub positions itself as a solution for organizing the private and community sharing of homes.

Unless a specific feature or offer expressly provides otherwise, KazaKlub does not set up a public rental booking system, does not set the financial terms of a stay between members, does not receive a commission on stays, and does not guarantee the existence of financial compensation or reciprocity between users.

Users agree not to divert the platform from its purpose by using it to organize unlawful, concealed, fraudulent transactions, or transactions contrary to applicable regulations.

If financial exchanges, expense reimbursements, contributions, considerations, or specific arrangements are agreed between users outside the tools expressly offered by KazaKlub, they are the users' sole responsibility.

Each user is invited to check the civil, tax, insurance, regulatory, or contractual consequences of any lending or occupation of a property.

10. General obligations of users

Each user agrees to use the platform in a fair, lawful, responsible, careful manner consistent with its purpose.

Users notably agree to:

• comply with these Terms;
• comply with applicable laws and regulations;
• not infringe on the rights of KazaKlub or third parties;
• provide accurate and up-to-date information;
• respect other members;
• not publish unlawful, misleading, or harmful content;
• not impersonate a third party;
• not divert the platform from its purpose;
• comply with the rules of the Klubs they participate in;
• respect the property, homes, and information made available to them;
• report any abusive, fraudulent, or dangerous behavior;
• reasonably cooperate with KazaKlub in the event of a check, report, or incident.

Users indemnify KazaKlub against any claim, action, demand, damage, loss, cost, or liability resulting from their content, their behavior, their statements, their violations of the Terms, or their failure to comply with a legal, contractual, insurance, or regulatory obligation.

11. Prohibited behavior

It is strictly prohibited to use the platform to:

• publish unlawful, defamatory, insulting, discriminatory, violent, hateful, threatening content, or content contrary to public order;
• infringe on the privacy, image, honor, or reputation of a third party;
• publish misleading, false, inaccurate, or fraudulent information;
• offer a property without rights or authorization;
• organize an unlawful, concealed activity or one contrary to applicable rules;
• circumvent the platform's rules;
• collect personal data without authorization;
• harass, intimidate, threaten, or discriminate against a user;
• transmit viruses, malware, or harmful code;
• carry out scraping, mass extraction, or unauthorized automation;
• attempt to access accounts, servers, or data without authorization;
• disrupt the operation of the platform;
• use the platform for competing purposes, abusive commercial purposes, fraudulent purposes, or unauthorized purposes;
• harm the image, interests, or security of KazaKlub.

KazaKlub reserves the right to take any useful measure in the event of prohibited behavior, including removing content, suspending a feature, limiting access, closing an account, reporting to the competent authorities, or taking any useful action.

12. Content published by users

Users remain solely responsible for the content they publish, transmit, upload, share, or make accessible on the platform.

They guarantee that they have all the rights, authorizations, and consents necessary for its publication.

Users grant KazaKlub, for the purposes of operating, hosting, displaying, moderating, internally promoting, and improving the platform, a non-exclusive, free, worldwide license, transferable to technical service providers, to reproduce, host, display, technically adapt, and communicate the content published on the platform.

This license is strictly limited to the needs of operating the platform and does not transfer ownership of the content to KazaKlub.

Users acknowledge that certain content may be visible to the members of their Klubs, to the people they invite, or to the users to whom they grant access according to the available visibility settings.

KazaKlub does not guarantee that the visibility settings chosen by a user will prevent any consultation, copying, screenshot, or unauthorized reuse by another user. Each user must therefore exercise caution regarding the information they share.

13. Moderation, reporting, and removal of content

KazaKlub may implement moderation, reporting, or control tools to preserve the proper operation of the platform.

Any user may report content, behavior, an account, a Kaza, or a Klub likely to be unlawful, abusive, fraudulent, dangerous, misleading, or contrary to these Terms.

Reports may be sent to: contact@kazaklub.com.

The report should, as far as possible, specify: the identity or contact details of the person making the report; the content, account, Kaza, or Klub concerned; the reasons for the report; the location or element enabling the content to be identified; any information useful for assessing the situation.

KazaKlub reserves the right to request additional information and to take any useful measure, without this constituting a general obligation to monitor.

KazaKlub may notably remove, hide, suspend, or limit access to content or an account when circumstances warrant it.

14. Security, trust, and verification

KazaKlub may offer tools, information, recommendations, features, or procedures intended to strengthen trust between users.

However, these tools do not constitute an absolute guarantee of identity, behavior, good faith, solvency, reliability, or security.

Users acknowledge that trust between members relies primarily on the relationships, choices, checks, exchanges, and decisions of the users themselves.

KazaKlub notably recommends that users: only invite trusted people; check important information before any lending arrangement; clearly define the rules for using a Kaza; check their insurance coverage; not share sensitive information beyond what is necessary; report any suspicious or abusive behavior; not accept conditions they do not understand or master.

KazaKlub cannot be held liable for a lack of verification, an error of judgment, a disagreement, inappropriate behavior, or a dispute between users.

15. Insurance, authorizations, and regulatory compliance

Each user lending or using a Kaza is solely responsible for checking their personal situation.

It is notably up to them to check: their rights over the property concerned; their home insurance contract; their civil liability; co-ownership rules; obligations arising from a lease or occupancy contract; applicable local rules; any applicable taxation; necessary authorizations; rules relating to safety, accommodation, use of the home, or hosting third parties.

KazaKlub does not provide personalized legal, tax, real estate, insurance, or regulatory advice. Any information made available on the site is general in nature and cannot replace professional advice tailored to the user's situation.

16. Free, premium features, and paid offers

The platform may offer free features and premium features.

Premium offers may notably provide access to certain additional features, organizational options, visibility tools, advanced services, expanded capabilities, or benefits related to the use of the platform.

Offers, prices, payment terms, renewal conditions, cancellation, refund, withdrawal, usage restrictions, and included features are specified on the commercial pages, subscription interfaces, applicable Terms of Sale, or Subscription Terms.

Upon subscribing to a paid offer, users accept the corresponding specific terms.

In the event of a contradiction between these Terms and Terms of Sale or Subscription Terms, the latter shall prevail for the commercial and financial aspects of the offer concerned.

KazaKlub reserves the right to modify, create, remove, suspend, or evolve its offers, prices, and features, subject to compliance with current contractual commitments and applicable regulations.

17. Partners, visibility, and third-party services

KazaKlub may highlight partners, recommended services, associated offers, or sponsored content related to its ecosystem.

These partners may notably relate to insurance, home maintenance, concierge services, owner services, amenities, mobility, local tourism, experiences, products, or services useful to platform members.

Highlighting a partner does not constitute an automatic guarantee of quality, availability, compliance, results, or suitability.

The relationship between a user and a third-party partner is governed exclusively by their own contractual terms.

KazaKlub cannot be held liable for the products, services, commitments, failures, content, prices, availability, or practices of partners or third-party services, except where mandatory legal provisions state otherwise or where it has made an express commitment.

KazaKlub may receive remuneration, commission, visibility fees, partnership fees, or commercial benefits related to highlighting certain partners, without this changing its role as a digital community organization platform.

18. Availability, evolution, and maintenance of the service

KazaKlub strives to ensure access to the platform under the best reasonable conditions.

However, the platform may be suspended, limited, modified, or interrupted at any time, in particular for: maintenance; updates; corrections; improvement; security; overload; breakdown; hosting incident; intervention by a provider; force majeure; evolution of the model or features.

KazaKlub does not guarantee permanent, continuous, uninterrupted secure access, error-free operation, or compatibility with all equipment, browsers, operating systems, or configurations.

KazaKlub may freely evolve the platform's features, notably as part of a beta phase, product development, testing, or continuous improvement.

Users acknowledge that certain features may be experimental, incomplete, modified, removed, or replaced.

19. Suspension, restriction, or deletion of an account

KazaKlub may suspend, restrict, or delete a user's access to all or part of the platform in the event of: non-compliance with these Terms; unlawful, abusive, fraudulent, or dangerous behavior; a serious report; infringement of a third party's rights; publication of prohibited content; attempted technical circumvention; use contrary to the platform's purpose; risk to the security, image, or interests of KazaKlub; prolonged inactivity; a request from a competent authority; a legal or regulatory obligation.

Where reasonably possible, KazaKlub may inform the user concerned of the reasons for the measure taken.

Suspension or deletion of an account does not give rise to any compensation, subject to the mandatory rights applicable to consumers and the specific conditions relating to paid offers.

Users may request the deletion of their account under the conditions provided by the platform or by contacting KazaKlub at: contact@kazaklub.com.

Certain data may be retained after account deletion when necessary to comply with a legal obligation, defend KazaKlub's rights, prevent fraud, ensure security, or under the conditions provided by the Privacy Charter.

20. KazaKlub's liability

KazaKlub is bound by a best-efforts obligation in providing the platform.

KazaKlub cannot be held liable for:

• content published by users;
• inaccurate, incomplete, or outdated information provided by a user;
• the actual availability of a Kaza;
• the quality, compliance, safety, or use of a property;
• relationships, agreements, disagreements, or disputes between users;
• the behavior of a member;
• damage caused by or to a user in the context of a stay or lending arrangement;
• a user's breach of their legal, tax, contractual, regulatory, or insurance obligations;
• misuse of the platform;
• a temporary or partial interruption of the service;
• an external event reasonably beyond its control.

KazaKlub does not guarantee that the platform will enable users to find a Kaza, obtain a stay, create an active Klub, maintain a relationship of trust, avoid any dispute, or achieve a particular result.

KazaKlub's liability may only be engaged in the event of proven fault directly attributable to it and within the limits provided by applicable regulations.

21. User liability and indemnification

Users are solely responsible for their use of the platform.

They indemnify KazaKlub, its directors, employees, service providers, and partners against any claim, action, demand, judgment, damage, loss, cost, fee, or liability resulting from: their use of the platform; their content; their exchanges with other users; the presentation, lending, or use of a Kaza; their breach of these Terms; infringement of third-party rights; communication of inaccurate information; fraudulent, abusive, or unlawful behavior; failure to comply with their legal, tax, contractual, insurance, or regulatory obligations.

This indemnification applies within the limits authorized by law.

22. KazaKlub's intellectual property

The site, the platform, their structure, architecture, features, interfaces, texts, graphic elements, logos, trademarks, distinctive signs, databases, code, developments, editorial content, and presentation elements are protected under applicable intellectual property rules.

Unless stated otherwise, these elements are the exclusive property of KazaKlub or are subject to a usage authorization.

Any reproduction, representation, distribution, extraction, modification, adaptation, translation, reuse, commercialization, or exploitation, in whole or in part, without prior written authorization from KazaKlub, is strictly prohibited.

Users shall in particular refrain from: copying or reproducing the structure or operation of the platform; massively extracting data; using content for competing purposes; misappropriating KazaKlub's distinctive signs; infringing on the identity, rights, or interests of KazaKlub.

23. Personal data

KazaKlub processes certain personal data in connection with the operation of the platform.

The methods relating to collection, use, retention, security, recipients, legal bases, users' rights, and the exercise of these rights are specified in the Privacy Charter available on the site.

Users may exercise their rights by contacting KazaKlub at the following address: contact@kazaklub.com.

Users agree not to publish or transmit third parties' personal data without valid authorization.

When a user invites a third party, provides information concerning a loved one, shares contact details, or publishes information involving another person, they declare that they have the necessary rights or authorizations and indemnify KazaKlub against any claim in this respect.

24. Cookies and trackers

The site may use cookies and other trackers under the conditions specified by the Cookie Policy or the Privacy Charter.

Certain cookies are necessary for the operation of the site and platform.

Cookies that are not strictly necessary, including certain audience measurement, personalization, advertising, or third-party service-related cookies, may be subject to users' prior consent when required by regulations.

Users may manage their preferences via the cookie management module, where available, or via their browser settings.

25. Hyperlinks and external resources

The platform may contain links to third-party sites, content, services, or resources.

KazaKlub exercises no control over these third-party sites and cannot be held liable for their content, availability, security, accuracy, privacy policies, business practices, or the consequences of their use.

Creating links to the KazaKlub site is authorized provided it does not harm the image, interests, rights, or reputation of KazaKlub and does not create any confusion regarding the existence of a partnership or authorization.

KazaKlub reserves the right to request the removal of any link it deems contrary to its legitimate interests.

26. Proof, electronic communications, and notifications

Users accept that exchanges with KazaKlub may take place electronically, notably by email, notification, message in the user's space, or display on the platform.

Computer records, connection logs, electronic confirmations, account data, technical history, and elements recorded by KazaKlub may be used as evidence, within the limits authorized by law.

Users agree to maintain a valid email address and to regularly check communications relating to their account.

27. Amendment of the Terms

KazaKlub reserves the right to amend these Terms at any time, in particular to take into account changes to the platform, services, business model, regulations, case law, security, or its internal organization.

The applicable version is the one published on the site at the time the platform is used.

In the event of a substantial change, KazaKlub may inform users by any appropriate means.

Continued use of the platform after publication or notification of the new Terms constitutes acceptance thereof.

If users refuse the new Terms, they must stop using the platform and may request the deletion of their account.

28. Force majeure

KazaKlub cannot be held liable for any failure or delay in performing its obligations resulting from a case of force majeure or an event reasonably beyond its control.

This notably includes, without this list being exhaustive: major breakdown, cyberattack, hosting incident, network interruption, natural disaster, fire, strike, pandemic, administrative decision, war, riot, failure of an essential provider, or an event making it impossible or abnormally difficult to provide the service.

29. Partial invalidity

If a provision of these Terms is declared null, unenforceable, or unopposable, the other provisions shall remain fully applicable.

KazaKlub and the user shall endeavor, where possible, to replace the provision concerned with a valid provision having an equivalent legal and economic effect.

30. No waiver

The fact that KazaKlub does not rely on a provision of these Terms at a given time cannot be interpreted as a waiver of its right to rely on it later.

31. Applicable law and dispute resolution

These Terms are governed by French law.

In the event of a difficulty, the parties shall endeavor to seek an amicable solution before any legal action.

Failing an amicable resolution, any dispute relating to the validity, interpretation, performance, or termination of these Terms shall be submitted to the competent French courts, subject to the mandatory rules applicable to consumers.

Consumer users retain the benefit of the mandatory protective rules applicable to them.
